Terms of Service

Effective January 2026

By accessing or using Voicemax's AI voice agent services (the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Services.

1. Acceptance of terms

These Terms form a binding agreement between you and Brandmax Inc.. If you are entering into these Terms on behalf of an organisation, you represent that you have authority to bind that organisation.

2. Description of services

Voicemax supplies managed voice agents to businesses. In practice that covers answering inbound calls, booking and changing appointments, screening enquiries, and dealing with routine service questions. The point of the Services is to make sure calls that would otherwise go unanswered are handled properly.

3. Account registration

Opening an account requires that you:

  • Give us registration details that are accurate and complete
  • Keep your login credentials secure and do not share them
  • Tell us straight away if you believe someone else has gained access
  • Are 18 or older, or otherwise able to commit your organisation to an agreement

4. Acceptable use

You must not use the Services in order to:

  • Break any law or regulation that applies to you
  • Infringe anyone else’s intellectual property rights
  • Carry content that is unlawful, harmful or abusive
  • Probe, scan or attempt to reach parts of our systems you are not entitled to
  • Disrupt or degrade the operation of the Services for anyone else
  • Carry out anything fraudulent, deceptive or misleading

5. Customer responsibilities

You are responsible for obtaining any consents and providing any disclosures required in your jurisdiction for call recording and messaging, and for the lawfulness of the contact data you provide to us.

6. Payment terms

What you pay depends on the plan you are on and how much you use. Fees already paid are not refundable unless we have agreed otherwise in writing. Pricing can change on 30 days’ written notice. If an invoice goes unpaid we may suspend the account and, in time, close it.

7. Intellectual property

The Services, and everything we have built into them, remain ours. Your data stays yours. By using the Services you give us the permission we need to process that data for the purpose of running them, and for no wider purpose.

8. Service availability

We work hard at reliability but we do not promise the Services will never be interrupted. We are not answerable for downtime, for filtering applied by carriers, or for outages at providers we depend on.

9. Carrier disclaimer

Calls and messages travel over networks we do not control. A carrier may block, filter, delay or simply drop traffic at its own discretion. Decisions made by carriers, and the deliverability and network performance that follow from them, are outside our responsibility.

10. Limitation of liability

So far as the law allows, we are not liable for indirect, incidental, special, consequential or punitive loss arising out of your use of the Services. Whatever the claim, our total liability is capped at the fees you paid us over the twelve months before it arose.

11. Indemnification

If a claim is brought against us because of how you used the Services, because you broke these Terms, or because you infringed someone else’s rights, you agree to cover us and our affiliates for the resulting damages and costs.

12. Termination

Either of us can end the agreement on 30 days’ written notice. Where these Terms have been breached we may cut off access at once. Once the agreement ends your right to use the Services ends with it, and we may erase your data after holding it for a reasonable period.

13. Governing law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of the Province of Ontario.

14. Changes to terms

These Terms may be revised. Where a change is significant we will publish the revised version on this site. Carrying on with the Services after that point means you accept the revision.
